Ricardo Bedoy believes that reviews at the 50% and 90% stages will provide the client and its consultants opportunities to discuss and develop strategies that will facilitate clear and competitive bids, and thereby, minimize, or avoid, negotiating issues when contract changes are realized during construction. When strategies are developed at the 50% stage, a more accurate and realistic cost estimate can be generated. Furthermore, the eventual bid proposal becomes a tool for administration and negotiating.
Bidability reviews during the design phase will yield lower bid prices and will enable the client to reach agreement with its Contractor on most contract changes in a timely manner. An added benefit is claims avoidance, since a well thought-out bid schedule leaves fewer obstacles to resolution. Ricardo Bedoy has always believed in an objective approach to resolving issues between the Contractor and the Owner. This philosophy has served our clients successfully; the same philosophy has also served Contractors and Design Engineers well. When all parties are actively attempting to meet the objectives of the project, in the end all parties walk away with a certain degree of success and satisfaction, knowing that the project was completed in a fair and equitable manner.
We believe that a team approach will inherently enable the participating parties to avoid a claim-riddled project. Although some potential claims may be unavoidable, strong working relations will enhance the probability of settling such claims in a timely and least expensive manner.
There are four basic factors that we believe help to avoid claims on a construction project. The four factors are listed below:

A good set of plans and specifications with minimal ambiguities; although there is no control over this factor once a project is bid. Constructability and bidability reviews can minimize negative effects. |

When plans, specifications, and documentation are poor, strong relationships between the Owner, Owner's Representative and Contractor's Project Manager can compensate somewhat in that the team will find a way to resolve an issue. However, good plans, specifications, and documentation will not compensate for poor relationships between parties. Above all, the most important factor is that of good relations based on mutual respect and trust among all parties involved.

Ricardo Bedoy, can review claims made by the contractor and prepare analyses as to the validity of the claim. Denial or recognition of the claim is the first part of the analysis. Our experience in construction administration enables for an objective review of the claim made.
Recognition of a claim then requires the preparation of an independent cost analysis. Ricardo Bedoy, prepares cost analyses independent of the contractor's requested amount in order to avoid any influence from other cost analyses.
We have extensive experience in analyzing contractor claims and is committed to providing fair and objective analyses. This approach will provide for an equitable resolution to all parties involved, and thereby, produce a project that is not riddled with unresolved disputes.

Although Ricardo Bedoy does not facilitate partnering sessions, we take an active role and it is has been our experience that a fully committed team can achieve things that could not be otherwise attained. Elements vary project to project, and some factors are so unique that people-skills, rather than technical-skills, are the skills that allow the team to navigate its way through difficult circumstances.
Genuine commitment, establishment of goals, and the development of trustworthy relationships are the key objectives of a partnership. Although participation at kick-off sessions can be strong by all interested parties, it is only the beginning. Genuine commitment and trustworthy relationships develop over the duration of a project, not in a few weeks.
In order for a project to be completed successfully, strong leadership is necessary at the project management levels. Although one might be truly committed to the partnership, there are those who are filled with suspicion and skepticism. We all know from our experiences that there will always be those who do not follow through on their commitment and are unwilling to admit their mistakes. Therefore, it is paramount that the key players on a project understand that it is "people" who reach resolutions, and not buzz words or cliches such as "partnering". One cannot simply state that he/she is "partnering" and expect to have a successful partnership; one must truly practice certain success traits.
In order for the partnership to succeed, there must be 1) people willing to partner and accept risk, 2) strong leadership, 3) ability to compromise, 4) persistence, and 5) a fair but firm attitude. These characteristics must be fulfilled on both individual and corporate levels, otherwise, genuine commitment is not really there.
In our experience, follow-up sessions are very effective when there is strong participation by all parties. The development of strong trustworthy relationships is an on-going process and one that can continue onto future projects. It is safe to say, perhaps, that partnering is nothing more than a process in which individuals, grounded in common goals, figure out how to work together based upon common sense and mutual trust.
